REGULATIONS FOR PARTICIPATION IN EVENTS ORGANIZED WITHIN THE ACTIVETIME PLATFORM
I. General Provisions
These Regulations define the terms and conditions of participation in events organized within the ActiveTime platform of the Media World Cup Foundation, managed by Aktive Sports Prosta Spółka Akcyjna with its registered office in Katowice, ul. 3 Maja (hereinafter referred to as “Aktive Sports”).
An event participant can be any adult person with full legal capacity who has made a reservation and paid the required fee in accordance with the terms of these Regulations. Minors may participate in events only under the supervision of their legal guardians.
Making an event reservation is equivalent to accepting these Regulations.
Aktive Sports reserves the right to amend these Regulations. The current version of the Regulations is always available on the website Activetime.eu.
II. Reservation and Payment
Event reservations can be made via the reservation form available on the website Activetime.eu.
After making a reservation, the Participant will receive a booking confirmation containing event details, the price, and the payment deadline.
Payment for the event should be made in full no later than 14 days before the event start date, unless otherwise specified in the terms of a given offer.
Payments can be made via PayPal or by bank transfer to the Aktive Sports account indicated in the booking confirmation.
In the event of failure to make payment within the required deadline, Aktive Sports reserves the right to cancel the reservation without the obligation to refund any advance payments made (if applicable).
III. Conditions of Participation and Participant Responsibility
The Participant is obliged to possess a valid identity document (ID card or passport) and any other documents required during the trip (e.g., visas, vaccination certificates).
The Participant is responsible for their health condition enabling participation in the activities planned in the event program. In case of any doubts regarding their health, the Participant should consult a doctor.
The Participant is obliged to comply with the laws in force at the event location and to follow the instructions of guides, tour leaders, and instructors.
The Participant is liable for damages caused through their fault to other participants, Aktive Sports, or third parties.
The Participant is obliged to have adequate travel insurance covering medical expenses, the consequences of accidents, and potential costs of event cancellation (if such an option was purchased). Aktive Sports may offer an insurance option, but the Participant has the right to purchase a policy from any insurer.
A Participant actively involved in the event program declares that they are aware of the risks associated with such activities and participates in them at their own responsibility.
IV. Changes and Cancellation of the Event
Aktive Sports reserves the right to change the event program for reasons beyond Aktive Sports’ control (e.g., weather conditions, force majeure, decisions of local authorities). In such cases, Aktive Sports undertakes to offer the Participant a substitute program of a similar nature or to refund the amount paid.
Aktive Sports reserves the right to cancel the event in case of an insufficient number of participants. In such a case, the Participant will be informed no later than 14 days before the event start date and will receive a full refund of the amount paid.
The Participant has the right to change the reservation (e.g., date, number of participants) provided there is availability and upon payment of any handling fee in accordance with the Aktive Sports price list. Changes to the reservation can be made no later than 14 days before the event start date.
V. Cancellation of Participation
The Participant has the right to withdraw from participation in the event. Cancellation requires written form (e-mail or letter).
In the event of cancellation, Aktive Sports reserves the right to deduct a handling fee in accordance with the following rules, unless otherwise specified in the terms of a given offer:
* Cancellation more than 30 days before the event start date: 100% refund of the amount paid.
* Cancellation from 30 to 14 days before the event start date: 60% refund of the amount paid.
* Cancellation less than 14 days before the event start date or failure to appear at the meeting point: no refund of the amount paid.
If cancellation insurance was purchased, the refund is made in accordance with the terms of the insurance policy.
VI. Complaints
The Participant has the right to lodge a complaint regarding the execution of the event. The complaint should be submitted in writing no later than 7 days after the end of the event.
The complaint should include the Participant’s details, a description of the irregularities, and the Participant’s expectations.
Aktive Sports undertakes to consider the complaint within 21 days from the date of its receipt and to inform the Participant about the outcome.
VII. Personal Data Protection
The administrator of Participants’ personal data is Aktive Sports PSA.
Participants’ personal data will be processed for the purpose of executing the event participation agreement and for Aktive Sports’ marketing purposes (with the Participant’s consent).
The Participant has the right to access their personal data, correct it, and request its deletion. Detailed information regarding the processing of personal data can be found in the Aktive Sports Privacy Policy available on the website activetime.eu.
VIII. Final Provisions
In matters not regulated by these Regulations, the provisions of the Civil Code and other generally applicable provisions of Polish law shall apply.
Any disputes arising in connection with the provision of services will be settled by the competent common court.
